English/ Español: Rubio Statement on Democrat Obstruction of Pro-life Bills
Washington, D.C. — U.S. Senator Marco Rubio (R-FL) issued the following statement ahead of the Senate’s consideration of the Pain-Capable Unborn Child Protection Act (S. 3275) and the Born-Alive Abortion Survivors Protection Act (S. 311):
“Protecting the life of a newborn who survived a botched abortion should not be a partisan issue, yet it speaks volumes about how extremism has become mainstream in today’s Democratic Party,” Rubio said. “I will always be a champion of the most sacred and fundamental of all human rights, the right to life.”
The Pain Capable Unborn Child Protection Act would make it illegal for any person to perform, or attempt to perform, an abortion without first making a determination of the probable post-fertilization age of the unborn child. If the post-fertilization age of the unborn child is determined to be 20 weeks or greater, an abortion shall not be performed, unless it is necessary to save the life of the mother or the pregnancy is a result of rape or incest. If these exceptions apply, the abortion may only proceed in a manner that provides the best opportunity for the unborn child to survive unless that would pose a greater risk of death or serious bodily injury to the mother. The Act makes clear that a woman who receives an illegal abortion in violation of this act may not be prosecuted.
The United States is one of only seven countries that allows on-demand abortions past 20 weeks. The other six are: North Korea, China, Vietnam, Singapore, Canada, and the Netherlands. Pain-Capable legislation has already passed in South Carolina and other states. They include Ohio, West Virginia, Wisconsin, Indiana, North Dakota, South Dakota, Nebraska, Kansas, Idaho, Iowa, Oklahoma, Texas, Louisiana, Arkansas, Mississippi, Alabama, Georgia, Kentucky, Arizona, and Missouri.
The Born-Alive Abortion Survivors Protection Act, which Rubio is a cosponsor of, would protect newborns that survive abortions by requiring appropriate care and admission to a hospital. The legislation requires that, when an abortion results in the live birth of an infant, health care practitioners must exercise the same degree of professional skill and care to protect the newborn as would be offered to any other child born alive at the same gestational age. It also requires that the living child, after appropriate care has been given, be immediately transported and admitted to a hospital. Currently federal law does not adequately protect a born child who survives an abortion.
